A Court of International Trade judge directed U.S. Customs and Border Protection to refund tariffs ruled illegal in February to all affected importers, including non-litigants. The government appealed the order to the Federal Circuit after the Supreme Court limited universal injunctions in a June 2025 birthright citizenship case. CBP has certified $100 billion in refunds, with most already disbursed.
