The U.S. Court of Appeals for the Federal Circuit ruled that the Trump administration is likely to succeed on the merits of its defense of 10% global tariffs imposed under Section 122 of the Trade Act of 1974 and allowed collection to continue while challenges proceed. The tariffs, capped at 15% for 150 days and set to expire July 24, follow an earlier Supreme Court decision striking down prior tariffs enacted under the International Emergency Economic Powers Act. The U.S. Court of International Trade had previously found the administration lacked authority and blocked the tariffs only for small-business plaintiffs.
