The U.S. Court of Appeals for the 2nd Circuit issued a 2-1 ruling on Friday upholding a district court decision that quashed grand jury subpoenas issued by John A. Sarcone III to the office of New York Attorney General Letitia James. The panel found Sarcone was not lawfully serving as Acting U.S. Attorney after his 120-day interim term expired on July 14, 2025.
